I have sat in the rooms where AI governance decisions get made. Not the board meetings where frameworks get cited and slides get presented — the actual working sessions where an engineering team is trying to figure out whether they need a legal review before training on this data set, and nobody is quite sure who owns that question.

What I have observed, consistently, across organizations of different sizes and sectors, is that most AI governance programs are built on the wrong foundation. They are built on documentation rather than on accountability. They produce policies that nobody enforces, frameworks that nobody operationalizes, and committees that nobody actually has to answer to.

The result is a governance program that looks complete from the outside and functions as theater from the inside. When something goes wrong — a bias incident, a privacy breach, an AI output that creates legal liability — there is paperwork but no clear owner of the decision that caused the problem.

This article is about the three specific mistakes I see most often, and what to do instead.

Mistake One: Treating governance as a compliance artifact

The first mistake is building an AI governance program specifically to satisfy an audit, a customer questionnaire, or a regulatory inquiry. The program is designed to produce evidence — policies, risk assessments, committee meeting minutes — rather than to govern actual AI development decisions.

You can identify this pattern by asking one question: does your governance process change what gets built, or does it document what was already decided?

In a documentation-first governance program, the review happens after the engineering decisions have already been made. The AI system is scoped, the training data is selected, the vendor is chosen — and then someone in GRC or legal is asked to review it. At that stage, review is not governance. It is retrospective documentation of choices that are already effectively locked in.

Real AI governance happens at the point where it can actually change outcomes. That means governance review happens at ideation — before training data is selected, before a vendor is contracted, before engineering resources are committed. The governance process is not a gate at the end of the pipeline. It is the foundation of the pipeline itself.

What this looks like in practice

An effective AI governance process requires any new AI feature or product to go through a formal review before any development begins — not before launch, not before testing, before development. The review covers the use case definition, the data sources, the vendor relationships, and the customer disclosure requirements. Until that review is complete and documented, engineering does not start. This is not a bureaucratic requirement. It is the mechanism that ensures governance can actually influence outcomes.

Mistake Two: Nobody owns the authorization decision

The second mistake — and the one with the most serious consequences — is the absence of a named individual who owns the decision to authorize an AI system for deployment.

Federal cybersecurity practice has a concept that commercial AI governance almost universally lacks: the System Authorizer. In federal systems, a named individual — not a committee, not a process, a specific person — reviews all documentation, assesses the residual risk, and makes a documented go/no-go decision. That person's name is on the authorization record. They are accountable for the decision in a meaningful, auditable way.

In most commercial AI governance programs, the deployment decision is made by committee consensus, by implicit approval through silence, or by the absence of a formal objection. Nobody owns it. When something goes wrong, the accountability diffuses across a working group and lands on nobody.

The fix is straightforward but requires organizational commitment: identify a System Authorizer for every AI system before development begins, make that person's name part of the formal record, and require their documented sign-off before any AI system moves to production.

Mistake Three: No defined triggers for re-review

The third mistake is treating AI governance authorization as a one-time event rather than a continuous obligation with defined re-entry points.

An AI system that was authorized in January based on a specific use case, specific training data, and specific user population is a different system in October if any of those three things have changed. But without defined triggers that require a new governance review, the original authorization extends indefinitely — covering decisions the original review never considered.

This is how incremental scope creep silently voids an authorization. Each individual change is small enough that nobody flags it as requiring re-review. The cumulative effect is an AI system operating well outside the boundaries of its original governance approval, with no one aware that the gap exists.

Effective AI governance defines re-submission triggers in advance — specific conditions that automatically require a new review regardless of how minor they seem individually. These typically include:

The key is that these triggers are defined and documented before deployment, not interpreted case by case after the fact. Teams should not be deciding whether a change is significant enough to require re-review. The triggers make that determination for them.


What effective AI governance actually looks like

Effective AI governance has three non-negotiable characteristics that distinguish it from the documentation-first approaches described above.

It is upstream, not downstream

Governance review happens before decisions are made, not after. The first governance gate is at ideation — before a line of code is written, before a vendor is selected, before training data is accessed. This requires organizational discipline to enforce, because engineering teams have strong incentives to move fast and governance feels like friction. The answer is not to remove the friction. It is to make the friction fast enough that teams follow it rather than route around it.

It has a named human decision-maker

At the authorization stage, a specific named individual reviews the complete documentation package and makes a documented go/no-go decision. This is not a committee vote. It is not an approval-by-silence. It is a named person with their signature on a record that says: I have reviewed this system, I understand the residual risks, and I authorize deployment. That person exists before development begins — not assigned at the last minute when the authorization deadline arrives.

It defines its own re-entry conditions

The governance program specifies, in advance, the conditions under which a previously authorized system must return for re-review. These conditions are documented in the authorization record itself. They are not subject to interpretation by the teams closest to the product. They are treated as bright lines — conditions met, re-review required, full stop.


The practical starting point

If you are reading this and recognizing your organization's current approach in the first three sections, the practical starting point is not a complete governance overhaul. It is three specific changes that can be implemented without rebuilding everything from scratch.

Move the first governance gate upstream. Whatever your current first review point is — move it one stage earlier. If review currently happens before launch, move it to before testing. If it currently happens before testing, move it to before development. Each step upstream increases the leverage of the review.

Name a System Authorizer for every active AI system. Go back to your current AI product portfolio and identify who, specifically, would sign an authorization record today for each system. If you cannot answer that question, you do not have accountability — you have the appearance of governance. Naming the person does not require rebuilding your process. It requires one decision and one documented record.

Define three re-submission triggers and document them. Start with the three most likely change scenarios for your organization — new training data, new user population, new vendor — and define them as hard triggers for re-review. Document them in writing. Communicate them to engineering and product leadership. You can expand the trigger list later. Three enforced triggers are worth more than twenty that nobody knows about.

AI governance is not primarily a documentation problem. It is an accountability design problem. The organizations that get this right are not the ones with the longest policy documents. They are the ones where the right people are asking the right questions before the decisions that matter are made.

That is what operational governance looks like. And it is the only kind that actually works.
